Terms of Service

Effective Date: January 2025

These Terms of Service ("Terms") govern your use of the mobile auto repair services provided by Swoop Service Auto LLC ("Company," "we," "us," or "our"). By booking a service with us, you agree to be bound by these Terms.

1. Services

Swoop Service Auto LLC provides mobile automotive diagnostics, maintenance, and repair services at customer-designated locations within our service area. The specific services, pricing, and scope of work will be detailed in the quote provided before service begins.

2. Service Area

Our primary service area is Los Baños, California and surrounding communities. Services outside a 10-mile radius of Los Baños are subject to additional travel fees as specified in our pricing schedule.

3. Booking and Appointments

Scheduling

Appointments are scheduled based on availability. We require accurate vehicle information and a valid service location to complete your booking.

Customer Presence

You or an authorized representative must be present at the scheduled service location with access to the vehicle. Failure to provide access constitutes a no-show.

Cancellation Policy

  • Cancellations or rescheduling with 24+ hours notice: No penalty
  • Cancellations or rescheduling with less than 24 hours notice: Deposit forfeited
  • No-shows: Deposit forfeited

4. Pricing and Payment

Labor Rates

  • $165 per hour — same rate inside and outside the 10-mile radius
  • Travel Fee: $20 base fee plus $1.00 per mile beyond 10 miles
  • One-hour minimum charge per service visit

Deposits

  • Jobs estimated at $150 or less: Full payment required at booking
  • Jobs estimated over $150: $50 non-refundable deposit required; balance due upon completion

Payment Methods

We accept electronic payments only (credit/debit cards, digital payment platforms). Cash is not accepted.

Additional Charges

If additional work is discovered during service, we will notify you and provide a revised estimate. Additional work requires your approval before proceeding. Any extra labor or parts will be added to the final invoice.

5. Customer-Supplied Parts

If you choose to supply your own parts, you assume full responsibility for part quality and compatibility. We are not liable for failures caused by defective, incorrect, or incompatible customer-supplied parts. Customer-supplied parts are not covered under our warranty.

6. Warranty

Coverage

  • Wear items (brake pads, belts, filters, etc.): 6 months or 6,000 miles, whichever comes first
  • Non-wear items (alternators, bearings, suspension, etc.): 12 months or 12,000 miles, whichever comes first

Warranty Exclusions

Warranty does not apply if:

  • The part fails due to lack of maintenance, abuse, or misuse
  • Another shop or individual performs work on the repaired component
  • The customer supplied the part
  • There is no documentation of the original repair

Warranty Claims

To make a warranty claim, contact us with your original service documentation. We maintain photos and records to support warranty verification.

7. Customer Responsibilities

You agree to:

  • Provide accurate vehicle information (year, make, model, engine type)
  • Provide an accurate service location with adequate space for repairs
  • Disclose known vehicle issues or concerns honestly
  • Ensure vehicle accessibility at the scheduled appointment time
  • Treat our technicians with respect and professionalism

8. Pre-Existing Conditions

Older vehicles may have rusted, seized, or corroded components. If parts break during removal due to pre-existing deterioration or prior improper repairs, we are not liable for the damage. Additional repairs or parts may be required and will be billed accordingly after notifying you.

9. Diagnostic Services

Diagnostic time is billable regardless of whether you proceed with recommended repairs. Our professional expertise and time have value, and diagnostic fees are non-refundable.

10. Safety Stop-Work

If we discover a major safety issue during service, we reserve the right to stop work until the condition is addressed. We will not proceed with repairs that would put you, our technician, or others at risk.

11. Limitation of Liability

To the maximum extent permitted by law, Swoop Service Auto LLC shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of use of the vehicle
  • Towing or storage costs if the vehicle cannot be driven after service
  • Damages arising from customer-supplied parts
  • Damages caused by pre-existing vehicle conditions

Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

12. Dispute Resolution

Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in Merced County, California, in accordance with the rules of the American Arbitration Association.

13. Termination of Service

We reserve the right to refuse or terminate service at our sole discretion for any reason, including but not limited to:

  • Abusive, threatening, or disrespectful behavior
  • Unsafe working conditions at the service location
  • Provision of false or misleading information
  • Non-payment or payment disputes

14. Indemnification

You agree to indemnify and hold harmless Swoop Service Auto LLC, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of our services.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Customer Policy and Privacy Policy, constitute the entire agreement between you and Swoop Service Auto LLC regarding our services.

18. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
